Deposition of witnesses

 

James Prosser of Arcteston in the county of Herefordshire labourer of the age of 29 years.

Item    to the last interrogatory this deponent says that James Parry shortly after Michaelmas (29th September) 1587 (as this examinate [=witness] remembers) procured some writ to the sheriff of Hereford to remove Mrs Parry out of the possession of the manor of Poston and that she and all her tenants were at that time expulsed out of the same manor and that Richard Bridges and Anthony Burne esquires (about one day before the said sheriff came to Poston to remove Mrs Parry) coming thither to Poston they came into the barn of Poston where this witness was threshing oats for Mrs Parry, and turned him out of the barn forbidding him to thresh there any more and this witness went and told his mistress thereof, who caused him to go into the barn again to thresh and to shoot the doors fast upon him at which time one Watkyn Morgan, James Parry’s man, sent for Bridges and Burne from the house of Robert Vaughan esquire where they were at dinner to come again to expulse this witness out of the barn who came and sent he thither and Watkyn Morgan breaking open the doors before them did let them in to this witness who was then and there by them beaten and the said Bridges with a wan that he had in his hand gave him such a blow upon his head that there remained the print of it a fortnight after. And throwing the corn that he had threshed from the floor to the moat expulsed this witness evil[y?] entreating him and more here to this deponent knows not.

 

Thomas Ball of Snodle husbandman of the age of seven and fifty years or there

abouts…he knows the manor of Poston & the tythes of Peterchurch parcel of the possessions of the said James parry and has known the same these 40 years.

…he says that the said Mrs [i.e. Mistress]. Parry was shortly after Michelmas in the 29th year of the reign of Elizabeth was expulsed out of the possession of the manor of Poston by the sheriff of the county of Herefordshire by virtue of a writ of amerca..s? man..? directed to him. .. that all her tenants were expulsed and lost their aftermath, grass, pannage, and profit of the Park, the mill of Poston and that her tenants did refuse to pay her rents because they could not enjoy their bargains. And that this witness having then a meadow in his possession taken at the hands of the said Mrs. Parry the which he was forbidden any longer to enjoy wherefore he doth detain 5s of the rent due upon him to be paid for the same…

Thomas Smythe of Madley in the county of Herefordshire smith of the age of lv years or there abouts  … did take certain parcel of pasture being parcel of the possessions of the James parry of Poston at the hands of Mrs Parry for that year at 18s rent which parcell of pasture this witness enjoyed until about lammas (1st August) of the said year shortly after which time this witness heard that the tenants or occupiers of the premises under Mrs parry were expulsed for which cause this witness durest? the l?ke profit of the said pasture the later part of the said year  in respect whereof this witness detained 4s 4d of the 18s rent from Mrs Parry…

 

Lewis Prosser of Vowchurch [father of James Prosser above] in the county of Herefordshire yeoman of the age of 70 years or there abouts …

He says that he doth know the manors of Poston and Tregoydwor and the tithes of Peterchurch parcel of the possessions of James Parry and hath known the same these 40 years…. he says that he heard that the same manors amongst other things with the glebe lands of Peterchurch were extended to her majesty for a debt in or about September last was three years.

He says that one Watkyn Morgan servant to James Parry did take the profit of the said manors or premises or the most part thereof during all that next year being the 28th year of Elizabeth’s reign (1586) to the use of James Parry.

He says that Watkyn Morgan take such profit as were to be received of the premises from the end of the 28th [regnal] year until about the 10th of May in the 29th [regnal] year saving 40s of rent for Tregoydwor which was paid to Mrs Parry for St. Mary day rent before her entry.

He says that Johan Parry the wife of James Parry had not the profit or occupation of the said manors & tithes from the feast of St. Michael the Archangel (29th September) in the 28th [regal] year to Lady Day in lent (25th March) in the 29th [regal] year then following, nor until the 10th May then next after, and shortly after she was expulsed as this witness heard and restored again to the same manors by the undersheriff and two justices of the peace the 1st June and he knows that she had the manor of Poston delivered unto her on the 10th May and he knew nobody that took the profit thereof during the half year before last past, but Watkyn Morgan James Parry’s man..

He says that he did hear that Mrs Parry ^and all ?? ??^ shortly after Michelmas in the 29th year of Elizabeth was expulsed by force of some p?cesse? foorthe? of the manor of Poston by the then sheriff of the county of Herefordshire, [????..]  and lost their aftermath, grass, pannage of the park, and profit of the mill of Poston and says that where he bought grass of the said Mrs Parry for 13s 4d rent during one year namely the 29th year of Elizabeth he did enjoy the profits of the same but two months only. And what hay, corn & straw was taken out of the barn he cannot tell but this he knows that his son was beaten evill? entreated by Richard Bridges and Anthony Burne esquires as he was threshing in Mrs Parry’s barn in Poston

Walter Daunce of Madle? in the county of Herefordshire yeoman … says that he did hear that shortly after Michelmas in the 29th year of Elizabeth, William Whitney esquire then sheriff of Herefordshire by force of some prect? to him diverted did remove Mrs Parry out of the possession of the manor of Poston and that she and all her tenants were expulsed and lost their aftermath (“later math”), grass and pasture growing upon the premises the later part of the said year?  and he says that he took that year the pasture of the Brick Close (SO353371) and Crabbe Meadow of Mrs Parry for that year for £? rent for himself and his friends and they enjoyed the same the Whitsun weak and they had no more grazing there? upon the Crabbe Meadow but the Whitsun week only and for the Brick Close he thinks that Mr Willyson being his ^co^partners enjoyed the same a fortnight long and further this witness says that they spared the same pastures for a second spring by reason thereof there was upon the same pasture as good grass being a second spring as was at the first but before this witness and his co-partners could have the benefit of the said second spring where upon they detained from Mrs Parry some of the rent …

Thomas Carwardyn of Chilston in the county of Herefordshire yeoman of the age of 60 years … says that he and one William Symons and John Carwardin …. having in their occupation one close or parcel of the premises called Crabbe Meadow taking of Mrs Parry as afore is mentioned did graze the first spring thereof in seven days only then ceased the same to receive a second spring thinking at the later end of the year to have received the profit thereof where upon about Michelmas this witness and his copartners were about to send their cattle there to graze that second spring but hearing that one Watkyn Morgan being servant to said James Parry and others of James Parry’s friends had expulsed Mrs Parry from the possession of the premises and impounded the cattle of all such as claimed in by Mrs Parry being on the ground, this witness and his copartners durst not put their cattle to graze the said second spring and so lost the profit thereof after …

Thomas Phe..? of parish of Peterchurch yeoman aged 48 being one of the surevies? (surveyors?) of Johan Parry to the sheriff for the extent of the manor of Poston & Tregrydwor ….

he says that he knows the manor of Poston & Tregrydwor & the tithes of Peterchurch parcel of the possessions of the said James Parry and hath known the same these 30 years  … and he says that the said Johan Parry had not any of the tithes of Peterchurch in extent or in her own occupation

…says that the same manor of Poston & Tregoydyvor were extended amongst other things to her majesty for a debt in & about September was three year last

..He says that one Waltkyn Morgan servant to James Parry to his master’s use

and by his commandment as this witness thinks took the profits of the said manor during all that next year being the 29th year of her majesties reign and this witness was one of Mrs Parry’s sureties for the money that year to the Queen majesty.

…He says that the said James Parry by Watkyn Morgan his man a dealer

for him for he knows no other deal for him did take the profits during those several

months in the second year next after the said extent being parti?st? 28th & 29th year

of her majesties reign that is to say in the months of November, December, January, February .March April & until the 10 day of May ^in the said 29th year^ that the said Johan Parry was put in possession of the manor of Poston & after expulsed & kept furth by Mr. Parry’s man until about the first of

June next after afne?^ch times^ she was restored by the justice of ??? to the undersherif [.. text in crease..]

…he sayth that the said Johan Parry the wife the said James

Parry had not the profits or occupation of the said manor of Poston from the feast of St Michael the Archangel in the 28th year of her majesties reign until our Lady day in Lent in the 29th year then next following and says the said Johan Parry had the possession of the premises delivered unto her viz the manor of Poston & Tregrydwor by Penry then undersherif first the 10th day of May & the was the holder f…rthe? for a time & restored as before is said about the first day of ?wn then next following and says that the said James Parry by his man Watkyn Morgan or Thomas Parry & Richard Parry brothers to the said James Parry had the profits of the rest during that half year  ?lud? the feast of the annunciation of our Lady in the 29th year of her majesties reign as this witness t??ck but he says Mrs Parry had the half years rent of Tregoydyvor being 50s due at St. Mary day before her entry viz the 29th year of her majesty…

..he says that shortly after Michelmas in the 29th year of the Queen’s majesties

reign the said Mrs. Parry was expulsed by the then sherif of the county of Herefordshire  out of the possession of the manor of Poston & that all her tenants in his knowledge were likewise expulsed  lost their later math grass & profits of the mill of Poston and further he says that the said Mrs Parry left behind her in the barn of Poston at the time of her expulsion about five bushels of oats,  two loads of hay and certain loads of straw the which one Watkyn Morgan servant to the said James Parry took to his master’s use and further where Mrs Parry had set certain pastures to one Mr. Willyson about the time of her expulsion the said sheriff’s men finding the cattle of the said Mr. Willyson grazing upon the said pasture drove the same cattle & impounded them in this deponents fold

 

by the procurement of the said Parry as he thinketh there was a writ of amercement? in anns? cam to the then sherif of the county of Herefordshire to remove Mrs Parry out of the possession of the manor of Poston…

 

He says that shortly after Michelmas in the 29th year of Elizabeth by the procurement of James parry as he thinketh there was a w?? (writ?) to use … can ..the then sheriff of Hereford to remove Mrs parry out of the possession of the manor of Poston and she and all her tenants were expulsed and lost their aftermath, grass … … …

lost the aftermath of Turnastones meadows which she has sold … (parchment damaged)

 

Griffith Jones of Monnington in the county of Herefordshire labour of the age of 30 years…

he says that he heard that the then sheriff of the county of Herefordshire by virtue of

such a writ as in the question is mentioned shortly after Michelmas in the 29th year of the Queen’s reign did expulse the said Mrs Parry out of the said Manor of Poston & Tregoydyvor & that she & all her tenants lost the later math of Turnestones meadows and other commodities they might have had if they might have enjoyed the premises accordingly for the whole year and further says that he knows that Mrs parry at the time of her expulsion left hay and straw behind her in the barn of Poston the quantity he does not very well remember which hay and straw one Watkyn Morgan servant to the said James Parry had to his masters use….

 

Roger Taylor of Poston .. yeoman .. 46 years old… he says that the said Mrs Parry by what authority he knows not shortly after Michelmas in the 29th year of the Queen’s majesties  reign was put furth of the said manor of Poston & her tenants lost their later math grass and pasture pannage of the park and the mill and says he heard that the said Mrs Parry left oats hay and straw in the barn of Poston to what value he knows not and says that he this witness did [see] four? heads of beasts with Watkyn Morgan in the pasture that Mrs Parry’s tenants were expulsed from called the mill meadow.

 

Richard D(orP?)eury of Blakemare in the county of Herefordshire gent of the age of 27 years or there about and examined v[er]ily upon the sixth and last question deposes and says that he this witness bought the later math of Turnestones meadowe parcel of the lands of Poston in the 29th year of the Queen’s majesty for iijli iiijs viijd (£3 4s 4d) [& has] heard that Mrs Parry should not enjoy the same manor of Poston nor h[er] tenants then he repaired to the [said] Mrs Parry requesting her to take the same meadow from him and to sell the same ?? s?? ??? which she then refused to do and shortly after the said Mrs Parry was removed by some p[ro]ces[s] & the cattle of her tenants were impounded & driven and so this witness lost the same later math and the said Mrs Parry had nothing ex[…] for the same.
