1. Impris doe you knowe the Mannor of Ewyas Lacie in the County of Hereff and howe longe have you knowne yt

 

2. Itm did you knowe Thomas Bromitch gent. in the Bill menconed and where did he dwell and what landes did he houlde in the severall pishes of Michelchurch and    Clodocke or either of them, and how much thereof did David Thomas ffather of the defens[ ] Lyson Thomas purchase or otherwise come by of the sayde Bromitch his landes and in whose possession or occupacon are those landes or anie p[ar]te thereof nowe, and of what yearlie valewe are thay & howe doe they mere & bounde on either side and how much there of hath beene esteemed & reputed Coppiehoulde and what howses and buildings are nowe standinge and beinge upon the sayde lande or anie p[ar]te thereof and who are ye dwellers therein and what houses were upon the sayde lande at the tyme of the saide purchase or graunt to the saide David Thomas and are they (& howe longe [since]) nowe defaced and was the messuage and landes or anie p[ar]te there of wherein Reece Harrie one of the defen[den]te now dwelleth p[ar]te of the said Bromitch his lande, and ever esteemed and  reputed to be Coppiehoulde lande and what annuall Rent hath or doth the said Rees Harrye payde or paye to the said Lyson Thomas or to anye other pson or psons for ye said lande or anie pteor p[ar]cell there of And what p[ar]te of the sayde Bromitche his exchanged and in whose possession or occupacon nowe are such lande or anie p[ar]te or pcell thereof and of what yearlie valewe and howe doe they meare and bounde on either side and were the said lande or most p[ar]te thereof ever taken be reputed to be  Coppiehold and helde of the p[ ] [&] of his Mannor of Ewyas Lacye aforesayde And was the lande nowe in the occupacō of the sayde Reece Harrie sometime the lande of Margeret vergh David Gilbert

 

3. Itm doe the sayde defente William Harrie Griffeth or anie other of the defente, houlde or [mioyd] ffower acres or thereaboute of welshe measure lyinge in Michelchurch or Clodocke afore- sayde or either of them beinge p[ar]cell of the said Mannor of Ewyas Lacie sometimes purchased or otherwise come by, by David Thomas gent ffather of the defendt Lyson Thomas of one Nicholas William Thomas Powell, or Harrie William Thomas Powell in the Bill menconed And hath the same lande or anie p[ar]te or p[ar]cell thereof beene overtaken or reputed to be Coppiehould lande and what houses & buildings are upon the same or anie p[ar]te thereof & at whose chardge were thay built & whoe are the dwellers thereinor have been built  since the purchase thereof by the sayde David Thomas and are nowe ruinated & defaced and of what yearelie valewe is the same lande and howe thay or anie p[ar]te thereof meare & bounde.

 

4. Itm doe the said defendte Henry Griffeth or anie of the said defendte there or anie of theire assignes or anie other person or persons holde or enioye eight acres of lande of Welshe measure more or less lyinge in Michelchurch or Clodocke aforesayde p[ar]cell of the  said Mannor of Ewyas Lacie and sometimes weare in the tenure of Nicholas William Thomas Powell or Henrey William Thomas Powell and hath the same lande or anie p[ar]te thereof during the time of yer knowledge beene taken or reputed to be Coppiehoulde lande & howe longe since weare thay graunted & by what Stewarde & by whose surrender and whoe received the ffine and other proffitte thereof or the rent thereof and howe and howe much was yt, and of what yearelie valewe is the same, and howe doe the same lande meare & bound on either side and what houses & buildinge are there nowe upon the same lande, or any p[ar]te or p[ar]cell thereof  and of whose chardge weare they built & whoe are the dwellers therein or what howse or howses have beene upon the same lande since the purchase thereof by the sayde David Thomas & are nowe defaced And what p[ar]te of the same lande or Tennemente have beene solde on & changed by the sayde David Thomas or Lyson Thomas the defendte & howe longe since to whome & of what valewe & in whose possession are they nowe & howe doe thay meare & bounde. 

 

5. Itm doe the said defendte David Thomas Prosser or Phillip Griffeth or anie other of the  defendte or anie other person or persons holde or enioye ffower acres more or less of Welshe measure p[ar]cell of the  said Mannor of Ewyas Lacie in Michelchurch lyinge in or neere a place called the Hentlande ande hath the same lande or anie p[ar]te thereof duringe all the tyme of yer knowledge beene taken & reputed to be Coppiehoulde lande & howe longe since weare thay graunted & by what Stewarde & by whose surrender and whoe received the ffine or other proffitte therefore And howe longe hath the sayde defendte David Thomas Prosser or Phillipe Griffeth or anie of the defendte, or anie other person or persons holde or enioyed the same & what howses & buildinge are there upon or upon anie p[ar]te thereof and whoe are the dwellers therein and whoe caused the  same to be built & at whose coste & of what yearelie valewe is the same & howe do the same  meare & bounde on either side And howe much thereof hath beene soulde & exchanged by  said David Thomas or Leyson Thomas the defendte or by anie other pson or psons And were the same lande or anie p[ar]te or p[ar]cell thereof purchased or otherwise come by, by David Thomas ffather of the defendte Lyson Thomas of Nicholas William Thomas Powell or Harrie William Thomas Powell in the Bill menconed. 

 

6. Item doth the sayde defendte Lyson Thomas or anie other of the defendte there or anie of their assignes or anie other pson or psons houlde or enioye two Acres of Coppieholde lande or thereabouts of Welshe measure beinge p[ar]cell of the sayde Mannor of Ewyas Lacie in Michelchurch aforesaid sometimes in the tenure of Henrey Rees David Prees or of [Rici] David ap Prees & boundinge on the one hed upon the  kinge highwaye leadinge frō Longtowne towarde Michelchurch and theother lande of the saide Lorde Bergevenneye called Tyre[ ]tuybough on the other hed. And in bredth betweene thether lande of the saide Lorde Bergevennye and the lande [aforesaid] of S[i]r  [late ] of our sovereigne ladie the Queene Elizabeth and in howe manie [severales] is all the saide Coppiehoulde lande nowe devided and w[hi]ch are errable pasture or meadowe & of what yearelie valewe is all the saide Coppieholde lande and what howse & buildinge are there nowe upon the saide lande & by [whowe] built & who are the dwellers therein and in whose hande or possession are the [saide lande] nowe or anie part thereof. 

 

7. Itm doe the saide defendte John Thomas Prees or anie other of the said defendte or anie other pson or psons houlde or enioye certayne lande called Tyre Stumpe or [Lle] Bigo sometimes the lande of [Jeu   ] David Powell & Maude his wife and Mile Hunt or Jenkin Hunt anie of them w[hi]ch  said Mile Hunt or Jenkin Hunt souled it to the said Lyson Thomas or his said ffather lyinge in the pishes of Michelchurch or Clodocke or anie f them  & contayninge aboute 6 acres of Welshe measure and hath the same lande or anie p[ar]te thereof beene taken or reputed to be Coppiehoulde lande of the saide Mannor of Ewyas Lacie & howe longe hath the saide defendte or anie of them [theird] or anie of their assignes holde or enioyed the same Coppiehoulde lande & howe doe they meare & boundeon either side and what is the yearelie valewe thereof & what howses & buildinge are there nowe upon anie p[ar]te of the saide lande & whoe are the dwellers therein or have beene since the purchase thereof by ye said David Thomas or Lysō Tho: the defendte or [believe] [                  ] or defaced & have longe since [       ] [  than] soe ruinated & defaced.  

 

8. Itm doe the saide defendte Lyson Thomas or anie other of the defendte theire [            ] of theire [diffe   ] houlde or enioye certaine lande lyinge in Michelchurch aforesaid parcell of the said Mannor of  Ewyas Lacie containing aboute [ ]ffive Acres of Welshe measure & sometimes in the tenure of [Hailin] John Richarde or his assignes & hath the same lande or anie p[ar]te thereof all the time [oflyd] time l     ] beene taken or reputed to be Coppiehoulde lande. And howe longe have the saide defendte or [time of] them theire or any of theire Assignes or anie other son or psons helde or enioyed the same lande whoe [ansed] the same to be built  & howe doe the same [houses & lande] meare & bounde on either side.

Itm doe the saide defendte Lyson Thomasor anie of the said defendte or anie other pson or psons houlde or enioye certaine lande called Tyre Cough (or by what other name or names [soewich] be called) contayninge [aboute] [      ] acres [     Welshe] measure beinge [                      ] Manor of Ewyas Lacie lying in the severall pishes of Michelchurch &Clodocke [or of theire sometimes in the tenure of Jenkin Thomas [      ] Philipe Harrie [mchfind] [                                                    David Thomas                                              Lyson Thomas and was p[ar]te ] [                                                       Thomas                                                                     hath the]  [                                                                                             Coppiehoulde lande and in whose possession] or occupacon are the same land nowe or anie p[ar]te thereof and howe doe thay meare & bounde [in ] either p[ar]te and what owses & buildinge are nowe uppon the same lande  or anie p[ar]te thereof & whoe caused the same to be built And are they nowe defaced & who are or have beene the dwellers therein Ande of what yearelie valewe all the same lande he purchased of the said Jenkin Thomas or Reece Philipe Parrie  And howe doe all the same lande nowe meare & bounde on either side. 

 

10. Itm doe the said defendte Lison Thomas or anie other of the said defendte theire or anie of  theire assignes or anie other holde or enioye Twentie acres of lande or theraboute pell of the said Mannor of Ewyas Lacie lyinge in the said severall pishes of Clodocke & Michelchurch or one of them called Tyre [ ]atta and hath the same lande or any p[ar]te thereof all the time of yo[u]r knowledge beene taken or reputed to be Coppiehoulde lande and howe longe have the said defendte  or anie of them theire or anie of theire Assignes or anie other pson or psons helde or enioyed ye same lande & of what yearelie valewe is the same & what buildinge [are] or have beene upon ye same lande and whoe are the dwellers therein & when & whoe caused the same to be built & howe doe the same lande meare & bounde on either side. 

 

11. Itm doe the sayde defendte John Thomas Prees or anie of the defendte or anie other pson or psons or psons holde or enioye Twentie acres of lande of Welshe measure or thereaboute p[ar]cell of the sayde Mannor of Ewyas Lacie lyinge in the severall pishes of Michelchurch & Clodocke or one of them and sometimes in the tenure of Nicholas William Thomas Powell or Henrey William Thomas Powell, or either of them and hathe  the same lande or anie p[ar]te thereof duringe  all the tyme of yr knowledge, beene taken or reputed to be Coppiehoulde lande and howe longe have the said defendte theire or anie of theire Assignes or anie other helde or enioyed the lande and of what yearelie valewe are the same lande & howe doe thay meare & bounde on either side & what buildinge are or have beene upon the sayde lande & whoe caused the same to be built. 

 

12. Itm what messuage lande & tenemente beinge p[ar]cell of the sayde Mannor of Ewyas Lacie doe the sayde defendte or anie of them theire or any of theire assignes holde or enioye & howe longe have they or anie of them helde or enioyed ye same & when & who causeth ye same to be built. 

 

13. Itm did David Thomas ffather of the defendte Lyson Thomas of purpose to inlardge hid demesnes or the pke belonging to his then mancōn home lyinge in the sayde pishes of Michelchurche or Clodocke p[ar]cell of the sayde Mannor of Ewyas Lacie nowe in the tenure of the sayde defendte  Lyson (or to inlardge anie other of his messuages or) deface anie Coppiehoulde Messuage lande or tennemente p[ar]cell of the sayde Mannor of Ewyas  Lacye, or deface the meares & bounde thereof to the intent the same shoulde not be disernede from his ffreehoulde messuage lande or tennemente p[ar]cell of this sayde Mannor & of whome did the sayde David Thomas purchase anie Coppiehoulde lande or tennements p[ar]cell of the said Mannor  of Ewyas Lacie declare the same w[i]th the meares & bounde thereof and in whose occupacon the  same is nowe & the yearelie valewe thereof And are all the Messuage lande & tennte name in the tenure of the sayde Lyson Thomas or his tennante lyinge in the pishes of Michel- church and Clodock w[i]th pcelll of the Mannor of Ewyas Lacie aforesaid or have the most p[ar]te thereof from tyme to tyme beene taken & reputed to be Coppiehoulde & helde of the p[ ] and what buildinge are or have beene upon the said lande or anie p[ar]te  or p[ar]cell thereof and whoe caused the same to be built. 

 

14. Itm hath the defendte Lyson Thomas beene du[s ] tunes somōned to appeare to do[ ] his suite of Co[  ] for the lande he houldeth of the p[  ] and shewe his Coppies at the p[  ] Co[eth] of Survey holden for the said Mannor of Ewyas Lacie & did the sayde defendte Lison appeare at any time or refuse to appeare or shew his Coppies.

Deposicōns of witnesses taken at Longtowne in the Com of Hereford the xxijth daie of August in the second yeare of the Reigne of or Sovraigne Lord King Charles before Thomas Welshe Esq[ui]r[e] [Humph]     Berington gent & Charles Boothe gent by vertue of the Comission hereunto annexed. 

 

James Parrie of Michaelchurch Esclie in the said Countie gent aged aboute fowerscore x[ ]xvjne yeares sworne & ex[tried] deposeth as followeth. 

 

To the first interrogatory he deposeth that he knoweth the mannor of Ewias Lacie in that interrogatorie menconed & hath knowne it lxx[n] yeares last past. 

 

To the second he deposeth that he knewe Thomas Bromw[i]ch gent in that interrogatorie named & that he dwelt in a howse sometimes of Madock ap Rees under the Blackhill in the pish of Clodock in the said Com & that the same Bromw[i]ch had divers lande & [leaveth] in the said severall pishes, bu[d] that David Thomas father of the defendte Leyson purchased of the said Bromw[i]ch certen freehold lande now holden of S[i]r  Raphe Hopton knight & also xviij acres of land of Welsh measure or thereaboutte holden by copie of court rolle of the said p[ar]te as of his said mannor of Ewiaslacie, & that the same copihold lande are of the yearelie valewe of vli or thereaboute & that there is a cottage upon the same copihold lande w[hi]ch is all the buildinge that e[ure] this depon[en]t knewe to be thereon & that the messuage & lande wherein the def[enden]t Rees Harrie now dwelleth beinge in the said pish of Clodock were p[ar]cell of the free lande & tenemt w[hi]ch the said Bromw[i]ch held as is aforesaid & who are holden of the said Hopton. 

 

To the 3d he deposeth that the def[enden]t Williamm Harry Griffith as tenant unto thothr def[enden]t Leyson holdeth three acres of copihopld land of English measure or thereaboute in Michaelchurch Esclie aforesaid of the said p[ t] as of his said manor being p[ar]cell of the copihold lande heretofore graunted to Harry William Thomas Powell w[hi]ch the said David Thomas purchased of the same Harry wth other copihold lande holden of the said p t as of his said mannor amountinge to seven acres of land of welsh mesure (whereof the said three English acres are pcell) & that there hath bene a messuage upon the same lande aboute 40 yeares last past being now ruinated (the same lande beinge of the yearelie valewe of iiijli vjs viijd. 

 

To the 4th he deposeth that the def[enden]t Harry Griffith as tenant to the def[enden]t Leyson holdeth all the copihold lande in the 3d interrogatory menconed saving the three English acres in the same interrogatorie specified and that the said Henry Griffith as tenant of the said Leyson holdeth one acre & a half being freehold lande under the p t as of his said manor upon [pl] whereof the messuage standeth & is reputed to be p[ar]cell of the same freehold & that all the rest of the lande now in the occupanc of the def[enden]t Harry Griffith are copihold lande holden of the p t as of the said mannr. 

 

To the vth he deposeth that the def[enden]t David Thomas Prosser holdeth one messuage & viij[e] acres of land of welsh mesure being copihold lande holden of the said p t as of his said manor lieng in Michaelchurch aforesaid of the yearelie valewe of aboute iiijli graunted to the said David Thomas Prosser aboute x[a] yeares last past for xxj yeares then next followinge by Mr Notte then Steward of the said manr whoe received xxli or thereaboute in lieu of the fine for the same & that all the lande now in the possession of the said Prosser are copihold lande holden of the p t as of his said manr (the said messuage being built at the cost of the said Prosser, & that [enresuice] the same graunt the said Prosser hath held & enioyed the same messuage & lande and taken the [Effitte] thereof. 

 

To the vjth he deposeth that the def[enden]t Leyson or his assignes holdeth twoe acres of copihold lande of English mesure under the p t as of his said manr in Michaelchurch aforesaid heretofore purchased wth other lande by the def[enden]t Leyson of Rees Henry Dd Prees, & as for the meres & bounde thereof he this depon[en]t referreth himself to the Court rolle of the said manr & the surveyes thereof and that the def[enden]t Leyson hath held the same aboute vj yeares last past beinge of the yearelie valewe of aboute iijs. 

 

To the 12th he deposeth that the def[enden]t Leyson holdeth the one half of certen copihold lande under the p[  ] as of his said manr lieng in Michaelchurch & Clodock aforesaid or in one or both of them w[hi]ch sometimes were the lande of Lewis Richard Thomas Lewellin, thothr alf being copihold under the p[] as of his said manr lieng in Michaelchurch aforesaid & now in the possession of Watkin Lewis Richard, upon w[hi]ch last moytie is an antient messuage, & allso that the said Leyson holdeth three acres more of lande of welsh mesure lieng in Michaelchurch aforesaid being copihold lande under the p[  ] as of his said manr w[hi]ch sometimes were purchased by David Thomas father of the def[enden]t Leyson of one David Morgan aboute fiftie yeares last past, of w[hi]ch said lande this depon[en]t engrossed the copie at the time of the graunt & he deposeth that some p[ar]te of the said three acres are p[ar]cell of the demesnes of the def[enden]t Leyson belonginge to his now mansion howse in Michaelchurch aforesaid & the residue thereof is lett & [decaised] by the said Leyson & that the said Leyson holdeth divs freehold messuage lande & [tente] being p[ar]cell of trhe said manr of Ewiaslacie, the yearelie valewe thereof he knoweth not. 

 

Margarett the late wife of Rees Harry Rees decessed late of Newton in the said Com wydowe aged aboute 40 yeares sworne & exāied deposeth as followeth. 

 

To the vjth interrogatorie she deposeth that Harry Rees father of this depon   said husband in his life time acquainted this depot that the p[   ] fathr then lord of the said manr did challenge twoe acres of lande of welsh mesure in Michaelchurch aforesaid to be copihold lande holden of him as of the said manr w[hi]ch said twoe acres doe lye in three severall closes in Michaelchurch aforesaid as she conceiveth w[hi]ch closes she saieth doe mere & bounde on [thone] head upon the kinge highe way leading from Longtowne aforesaid towarde Michaelchurch aforesaid & the p[  ] free lande called Tyr Tye Baughe on thother head & in breadth betwene the p[  ] free lande & the lande sometimes of or late soveraigne lady Queen Elizabeth but whether the said closes be copihold or not she knoweth not & she saieth that this deponte said husband sold the said closes together w[i]th oth[e]r lande to the said def[enden]t Leyson Thomas 

 

Margarett ap Jevan of Newton in the said Com wydowe aged lx yeares or thereaboute sworne & exāied deposeth as followeth. 

 

To the 8 interrogatory she deposeth that the said David Thomas fathr of the def[enden]t Leyson did buye five acres of copihold land of welsh mesure conteyning twoe closes w[i]th divs other lande lieng in Michaelchurch aforesaid of William John Richard being this depon[en]t father & that there hath bene an antient messuage upon the same lande & sithence pulled downe by the said David Thomas & that the same lande are holden of the p[  ] as of his said manr but by what service she knoweth not.   

 

Katheryne Powell of Michaelchurch aforesaid aged aboue lxxv[ve] yeares sworne and exāied deposeth as followeth. 

 

To the 3d interrogatorie she deposeth that the def[enden]t David Thomas Prosser doe hold one acre of land of welsh mesure p[ar]cell of the 4 acres in that interrogatorie menconed lieng in Michaelchurch aforesaid being copihold lande under the said p[  ] as of the said manr & that the def[enden]t William Harry Griffith doe hold certen copihold  land under the p[  ] as of his said manr & that there is a messuage upon the freehold land w[hi]ch is in the occupancie of the said William & holden of the said p[   ] as of his said manr, & that Niccoll William Thomas Powell this depon[en]t father sold the said copihold land wthother  free lande to the said David Thomas father of the def[enden]t  Leyson she saieth that if she were upon the lande she could mere & bounde some pt of the same copihold lande from the same freehold lande.

 

Thomas John Lewis of Lanveyno in the said County Yeom aged aboute lxx[  ] yeares sworne & exāied deposeth as followeth. 

 

To the first interrogatorie he deposeth that he knoweth the manr Ewiaslacie in that interrogatorie mencōned & hath knowne it xxxvj yeares. 

 

To the second he deposeth that he knew Thomas Bromw[i]ch gent in that interrogatry mencōned & that he dwelt in the howse & lande where the def[enden]t Rees Harry now dwelleth lieng in the said pish of Clodocke & that the said Bromw[i]ch did hold xvjne of copihold land of welsh mesure under the p[  ] father as of the said manr & allso did hold twoe acres of copihold land of like mesure under the said p[  ] father as of the said manr being in Michaelchurch aforesaid And that the deft Leyson Thomas his said father purchased the same (inter al) of the said Bromw[i]ch being of the yearelie valewe of vijli or thereaboute p[ar]te of w[hi]ch said lande viz aboute 14 acres of welsh mesure one Leoard Mason or his assignes now holdeth by the graunte of the p[  ] or his said fathr and his depon[en]t saieth that he as Bailiffe of the said manr received duringe the space of sixtene yeares the yearelie rent issuinge out of the same lande of the tenante of the def[enden]t Leyson Thomas for the whole xviijne acres. 

 

To the 3d & 4th interrogatorie he deposeth that he as Bailiffe of the said manr did receive of the def[enden]t William Harry Griffith xxiijd & other def[enden]t Harry Griffith xxijd beinge undertenante of the deft Leyson for certen copihold lande conteyninge aboute xijve acres of land of welsh mesure lieng in Michaelchurch aforesaid holden of the said lord as of the said manr of Ewiaslacie w[hi]ch were purchased inter al by the def[enden]t Leyson Thomas his said father of Niccoll William Tho. Powell or W[illia]m Thomas Powell in those interrogatories mencōned beinge of the yearelie valewe of vli & that there are twoe messuage upon the freehold lande holden of the p[  ] as of the said manr now in the tenure of the said Harry Griffith & William Harry Griffith.  To the vth he deposeth that the def[enden]t David Thomas Prosser holdeth one messuage & eight acres of land of welsh mesure being copihold lande under the p[  ] as of the said manr lieng nere a place called the Hentland in Michaelchurch aforesaid being of the yearelie valewe of vli [Wth the def[enden]t Leyson This in faint ink, maybe a partialy erased error] 

 

To the vjth he deposeth that the def[enden]t Leyson or his undertenant holdeth half one acre of land of welsh mesure being copihold lande holden of the p[  ] as of his said manr lieng in Michaelchurch aforesaid for w[hi]ch this depon[en]t as Bailiffe of the said manr hath received the yearelie rent issuinge out of it, w[hi]ch said half acre the def[enden]t Leyson purchased of Rees Harry Rees amongest oth[e]r freehold lande beinge of the yearelie valewe of ijs. 

 

To the vijth he deposeth that the def[enden]t John Thomas Prees as tenant to the def[enden]t Leyson holdeth three acres of land of welsh mesure beinge copihold lande holden of the p[  ] as of the said manr  received the yearelie rent issuing out of it & w[hi]ch copihold (inter al) were purchased by the def[enden]t Leyson his said fathr of Jenkin Hunt decessed aboute xxvj yeares last past being of the yearelie valewe of xxs. 

 

To the xijth he deposeth that Thomas Lewis Prees as tenant unto the def[enden]t Leyson holdeth xjne  acres& half one acre of copihold land of welsh mesure of the p[  ] as of the said manr lieng in Clodock aforesaid heretofore graunted by copie of court rolle to the said Leyson Tho: his said father being of the yearelie valewe of iiijli xs. 

 

To the xiijth he deposeth that the def[enden]t Leyson Thomas his said father purchased sixe acres of copihold land of welsh mesure holden of the p[  ] as of the said manr  of one David Morgan lieng in Michaelchurch aforesaid now in the occupancie of the def[enden]t Leyson being of the yearelie  valewe of xxiiijs, for w[hi]ch this depon[en]t as Bailiffe of the said manr received the yearelie rent issuinge out of it. 

 

To the xiiijth he deposeth that this depon[en]t being Bailiffe of the said manr did of late somon the def[enden]t Leyson by vertue of a sufficient warrant to him this depon[en]t directed to appe at a court Baron & Court of Survey late holden for the said p[  ] for the said manr to doe his suit of court and to shewe his severall estates & copies of court rolle, whereat the def[enden]t Leyson apped accordinglie but shewed not unto the Steward of the said manr then any copies of court rolle how he holdeth the said copihold premisses to this depon[en]t knowledge.

To the first interrogatorie he deposeth that he knoweth the manr of Ewiaslacie in that Inter. menc[i]oned & hath knowne it fiftie yeares last past. 

 

To the 3d & 4th interr. he deposeth that the def[enden]t William Harry Griffith as tenant to the def[enden]t Leyson Thomas holdeth twoe acres of copihold land of welsh mesure holden of the p[  ] as of the said manr lieng in Michaelchurch aforesaid w[hi]ch the said David Thomas father of the def[enden]t Leyson purchased aboute 40 yeares last past amongest other lande of Nicoll William Thomas Powell & Harry William Thomas Powell or one of them being of the yearelie valewe of xxs& that he can mere & bounde some p[ar]te of the same lande if he were upon it, & that the said William Harry Griffith hath confessed unto this depon[en]t the said twoe acres to be copihold as is aforesaid & he further saieth that the defet Harry Griffith as tenant to the def[enden]t Leyson holdeth viije acres of copihold land of welsh mesure holden of the p[  ] as of the said manr lienge in Michaelchurch aforesaid w[hi]ch the said David Thomas purchased inter al, of the said Harry William Tho: Powell or Niccoll William Tho: Powell beinge of the yearelie valewe of iiijli & that the said Harry Griffith hath & doth acknowledge all the lande in his occpancie lienge in Michaelchurch aforesaid to be copihold under the p[  ] savinge one acre & a half of land w[hi]ch he holdeth of the p[  ] (as he pretendeth) to be freehold.    

 

To the vjth interr. he deposeth that the def[enden]t Leyson Thomas aboute xn yeares  last past purchased of Rees Harry Rees (inter al) aboute half one acre of copihold land of welsh mesure holden of the p[  ] as of the said manr lieng in Michaelchurch aforesaid beinge of the yearelie valewe of iiijs now in  the occupancie of Katherine Coke wydowe whoe is tenant thereof to the def[enden]t  Leyson. 

 

To the vijth he deposeth that the def[enden]t John Thomas Prees as tenant to the def[enden]t Leyson holdeth [on]e medowe called Gworlod [Stupe] being copihold lande holden of the p[  ] as of the said manr lienge in Clodock aforesaid of the yearelie valewe of fiftie shillinge w[hi]ch  he said David Thomas purchased (inter al) of Jenkin Hunt.

3.   Doe yow knowe that the said Sir Henrie Nevill Knight Lord Bergavennie nowe dead did at the said Courte in the precedente Interrogatorie mencioned by the like Copie of Courte Roll of the said mannor of Ewas Lacie graunte to David Thomas aforesaid father of the defft Lysonne Thomas one barne and eleven acres and one half acre of wealch measure Called Tyre Evan ap Yerroth Giath  To have and to houlde the said barne and eleven acres and one half acre of wealch measure to the said David Thomas and his heires for the tearme of threescore yeares then next foloweinge at the yearelie Rente of twoe shillings tenne pence half penney at Michelmas onlie and hriotte after the decease and recease of everie Tenante of the premisses and is the Copie nowe shewed untoe yow subscribed with the names of the said Walter Baskervile and William Baker in the precedente Interrogatories mencioned And are the same names the prop. handewritinge of the said Walter Baskervile and William Baker.

 

4.   Doe yow knowe that the Custome of the mannors of Ewias Lacie and Ewias Harrold in the countie of Heref[ord] there used time out of minde whereof the memory of men is not toe the contrarie hath [buine] and is that if anie graunte by Copie of the Court Roll of the said Mannors bee made toe anie custommarie tenante of anie the Custommarie or Coppie houlde landes with in the said Mannors to have to the custommarie or Coppiehoulde Tenante within the said  Mannor and his heires for the tearme of one hundred yeares or moore or lesse yeares that after the decease of the said father or macester the eldest sonne and heire, at the comon lawe shall and ought to enioy the same Coppiehoulde and custommarie tonementes dureinge the said tearme declare yo[ur] knowledge herein and the p[ar]ticular circumstances thereof.

Doe yow knowe That David Thomas aforesaid father of the defdt Lysonne Thomas was seised in his demeane as of ffee And died seised of diverse messuages landes tenements and hereditannentes in the p[ar]ishes of Cluddocke and Sainte Michaell Escley in the said Countie of Heref[ord] of what yearelie value were the same reputed to bee and did the same p[re]misses descende and Come to Lysonne Thomas aforesaid after the decease of David Thomas.

James Parry of Michaell Churche Escley in the County of Heref[ord] gent aged ffower= scoore and sixtene yeres or thereaboute. Sworne and examined, as a witnesse on the defte behalfe upon the Interr: annexed  deposewth and saith as followeth / 

 

1.         To the first Interr. he saith that he doth not knowe the complt, but knoweth all the defte and did knowe David Thomas the plts father, William Baker and Walter Baskervile esq[uire]s deceased / 

 

2.         To the thirde Interr this depon[ent]  saith that he knoweth Eleaven acres of lande and an half or thereaboute, according to the welshe measure, called by the name of Lewys Richarde Thomas Lleus landes, And saith that he hath three that the same landes were graunted by Copie of Courte Role, unto David Thomas deceased the defte Leyson Thomas his late  father, for the tearme of threescore yeres, at and for the yerely Rente of three pence the welsh acre / 

 

4.                  To the fowrth Interr this depon[ent]  saith that the Custome of the said Manno[r] of Ewyas Lacy is, and tyme out of mynde hath bene there used, That if a graunt by Copie be made of any landes w[i]thin the said manno[r] for the Tearme of one hundred yeres, or for more or lesse yeres, that after the decease of such Teanant, the same lands ought to discende; and come to his heires at the Comon Lawe, unles the teanant doe Surrender, the same lands to some other p[er]son in his lyef tyme / 

5.                  To the fift Interr. this depon[ent]  saith That David Thomas in the Interr named, the defte said father dyed seised in ffee of divers lands w[i]thin the severall parishes of Clodocke and Michaell Church Escley within the County of Heref[ord] w[i]thin the fee of the p[arce]ll, And that the same descended and came unto the def[enden]t  Leyson Thomas, after the decease of his said father, beinge abouts one hundred Markes p[er] Annu[m] /   

 

Howell Harry Powell of the parish of Michaell Church Escley in the County of Heref[ord] yeoman aged threescore and five yeres or thereabouts sworne and examined as a witnes on the defte behalf upon the Interr annexed deposeth and saith as followeth  

 

1.   To the first Interr he this depon.saith that he doth not knowe the Complt, but did knowe th David Thomas, Walter Baskervile, and William Baker nowe  deceased, and knoweth all the reste.

John Carpenter and John Smyth gents the daie yeare and att the place above [spied] By vertue of a Comyssion to us and to Thomas Welshe Esq[ui]r[e] or any three or twoe of them directed out of his Math Court of Exchequer Chamber in a matter there dependinge betweene the Right H[onora]ble the Lord Burgevenny plt. and Lyson Thomas Esq[ui]r[e] def[enden]tupon the contente of the same Commission and of an order thereunto annexed. Together w[i]th the substance of the deede produced before the said Comissionrs in the behalf of the plt. 

 

John Delahaye of Alterenis in the county of Hereff. Esq[ui]r[e] aiged aboute 46 yeares sworne and examyned on the plte behalf. Deposeth that att a Court of Surveye kept and holden for and w[i]thin the Mannor of Ewyas Lacy in the said Comission and Order menc[i]oned the ffowerth of August in the Second yeare of the Raigne of  the kings most excellent Mate that now is by and before this deponent then and yet deputy Steward of the said Mannor There was procured before this deponent and the then jury and [homrye] of the said manor then sworne and in the presence of the defend. Lyson Thomas a Roll or Writtinge in Paper purportinge to be a Court Rolle of the said Mannor taken at a Courte of the said Mannor held the xvijth daie of October in the third yeare of the Raigne of our late Soveraigne Lord James of England after the  death of David Thomas Esq[ui]r[e] the said defents ffather before Anthony [V]embridge Esqr. then deputy Steward of the said Mannor wherein was contaigned (as the same Rolle purported) a Recognic[i]on made by the said def[enden]t both of the sev[er]all ffreehold and coppie hold Messuage Tenemente and Lande w[i]thin the said Mannor w[hi]ch the said def[enden]t Lyson Thomas then held w[i]th their severall quantities and in whose respective possissions the same then were, w[hi]ch Rolle and Recognic[i]on was then shewed unto  (and reade by the said defedt. who did neyther except agaynst it or Contradict the same in any p[ar]te thereof And thereupon the said jury or homage, att the said Court of Survey did fynde and present that the [defense] had and held the said severall Messuage Tenemente and lande p[ar]ticularly expressed in the said Recognic[i]on: And thereupon this deponent at the same Court made an entry and Rolle thereof, w[hi]ch together w[i]th the said former Rolle and Recognic[i]on were nowe shewed to this deponent And thereunto for the certenty thereof and of the quantities of the severall Tenement and Lande, and in whose possessiones the same then were. This deponent referreth hymself, but the meares or bounde thereof this deponent cannott expresse. And he saith That this deponent hath att severall tymes seene, and now was shewed hym a Booke of Survaye w[hi]ch was alleaged to be a Booke of a survaye taken of the said Mannor made at a Courte there holden the xxjth of September in the xxixth yeare of the Raigne of our late Soveraigne Lady Queene Elizabeth before William Sycel Esq[ui]r[e] Steward and certen Comissioners there wherein amongest other thinge  there was and is contaigned a Recgnic[i]on alleged to be made by the said David Thomas of severall Coppie hold Tenemente, and lande w[i]th their severall quantities w[hi]ch he then held ww[i]thin the said Mannor To w[hi]ch last menc[i]oned Booke this deponent also referreth himself.

Item he further deposethe that the def[enden]te Leyson Thomas houldeth a custom[er]ie  Tenem[ente] in the p[ar]ishe of Michael Church Escley the messuage thereof is defaced and pulled downe by David Thomas the def[enden]te late father conteyninge fyve acres of welshe measure lyeinge all togeather in three severall closes w[i]thin the p[ar]te of the def[enden]t Leyson Thomas whereof one close or p[ar]cell of pasture conteyninge aboute half a welshe acre extendeth upon thewest end to acerten hedge rowe of okes there nowe standinge and a certaine meare there extante betwene the same lande and the ffree lande of the said def[enden]t heretofore purchased by the def[enden]te father of one Harry David Powell, One other close close thereof beinge errable lande conteyneth a full welshe acre And lyethe on the north p[ar]te of the said half welshe acre and is meared Rownde on all other p[ar]te w[i]th the p[ar]ke [p]ale of the def[enden]te said p[ar]ke and a certen quicke hedge there growinge And saieth that theplace where the said messuage stoode and the residue of the p[re]misses are lyinge adioyneinge to the said laste menc[i]oned close, on the north side thereof All w[i]th custom[er]ie Premisses [nere?] somtymes heretofore in the possession of one William John Richard by vetue of a copye of Courte Roole under the Lord Burgavenny as p[ar]cell of his Mannor of Ewis Lacy and formerly surrendered by the said William John Richard unto David Thomas the def[enden]te said fathers use.

Item he further deposeth that the def[enden]te underten[a]nt Harry Grffith howldeth eighte welshe acres of copihould lande lyinge all togeather in sixe severall closes p[ar]cell of the Mannor of Ewys Lacy held of the Lord Burgavenny scittuat lyeinge and beinge w[i]thin the p[ar]ishe of Michael Church Escley in the County of Heref[ord] whereupon there was a messuage auncyiently, And heretofore defaced by David Thomas the def[enden]te ffather, whoe had the same by surrender from one Harry Powell, w[hi]ch eight welshe acres doe lye in leingthe betwene the highe waye aforesaid upon the weste end and a certen messuage and garden in the possession of the said Harry Griffithe And saiethe that the p[re]misses doe extend alsoe upon the easte end into ameadowe there in the possession of the said Harry Griffithe and doe lye betwene the lande of George Lewis Prees on the one side and the lande of David Morgan and Thomas David Maddocke on the other side. 

Item he further deposeth that one William Harry Griffith as Tenante unto the def[enden]t Leyson Thomas houldeth twoe welshe acres and a half of custom[er]ie lande p[ar]cell of the Mannor of Ewyas Lacy belonginge to the Lord Burgavenny w[i]thin the p[ar]ishe of Michaell Church Escley and county of Heref[ord] whereof one p[ar]te is called Errowe John Wynneth and that the p[re]misses doe lye togeather betwene the lande of George Lewys Prees on the one side and the ffree  lande of the said William Harry Griffithe on the other p[ar]tes w[i]th twoe welshe acres and a half meare boughte by the said David Thomas as of the surrender of Nicholl William Thomas Powell. 

 

David Thomas Prosser of the p[ar]ishe of Michall Church Escley in the  county of Heref[ord] yeoman aged ffowerscore yeares or thereaboute sworne and exa[m]i[n]ed as a witnes on the plte behalf deposeth as followeth

Impri[m]is he saieth that the p[ar]cell of meadowe and pasture lyinge in the  parke of the def[enden]t Leyson Thomas form[er]ly exp[re]ssed in the deposic[i]on of the form[er] depon[ent] Howell Harry Powell and the other twoe acres likewies exp[re]ssed in the said Howell Harry Powelle deposic[i]on was in the possession of one Jenkin David Powell before the same were surrendered by Thomas Mile Hunte and Maude his sister to the said David Thomas The def[enden]te said father But whether the same be ffree hould or copye hould lande this dep[onen]t doth not directly knowe for that he never enquired after the same nor ever heard any question made thereof before.

Inpris he deposeth and saieth that the eight welshe acres and the twoe acres and an half before in the deposic[i]on of the form[er] depon[ent] Howell Harry Powell menc[i]oned are copihould lande belonginge to the Lord Burgavenny as p[ar]cell of his Lo[rdshi]pe of Ewy[a]s Lacy And he this depon[en]t as bayliffe unto the said Lord Burgavenny hath gathered and receaved Rente for the same a[s] copihould lande of the Ten[ame]nte in possession thereof.
